Privacy Policy
Protecting the security and privacy of your personal data is important to Ksubaka. Therefore, we conduct our business in compliance with applicable laws on data privacy protection and data security. We hope the policy outlined below will help you understand what data Ksubaka may collect, how Ksubaka uses and safeguards that data and with whom we may share it.

When you provide us with personal data, we generally use it to respond to your registration, enquiry, and to give you specific information or offers.
We also collect large quantities of general data to understand the demographics, tastes, interests and other characteristics of the users of our playSpots. We use this to improve our service and to provide our clients with information on the perception of the experiences being run on our playSpots, or the nature of the people using our playSpots. Unless you have explicitly given us your contact details in association with you use of a playSpot, we will never link this general data with you.
Purpose Limitation
Ksubaka will collect, use or disclose personal information or data supplied by you, only for the purposes disclosed to you, unless the disclosure:
- Is a use of the personal data for any additional purpose that is directly related to the original purpose for which the personal data was collected
- Is required by law or the competent governmental or judicial authorities
- Is necessary to establish or preserve a legal claim or defence or
- Is necessary to prevent fraud or other illegal activities, such as willful attacks on Ksubaka information technology systems
Communications or Utilisation Data on websites
Through your use of telecommunications services to access our website, your communications data (e.g. internal protocol address) or utilization data (e.g. information on the beginning, end and extent of each access, and information on the telecommunications services you accessed) are technically generated and could conceivably contain personal data. When you access our websites, we may automatically (i.e. not by registration) collect non-personal data (e.g. type of Internet browser and operating system used, domain name of the website from which you came, number of visits, average time spent on the site, pages viewed). We may use this data to monitor the attractiveness of our websites and improve their performance or content.

When you use our playSpots in public locations, we gather information about the usage session: areas selected, speed of selection, time spent using the playSpot. We use this data to monitor the attractiveness of our playSpots and their content and improve their performance.
Storage and Security
To protect your personal data against accidental or unlawful destruction, loss or alteration and against unauthorized disclosure or access, Ksubaka uses technical and organizational security measures.
Ksubaka stores your personal information electronically. In most cases, we use password protected electronic databases maintained at our own sites, or that of a service provider, possibly involving a cloud hosting service. Backups of electronic information may be stored offsite. Your personal information may be stored indefinitely until you advise you would like it removed or destroyed, however we may de-identify or destroy it earlier as required by law.
Over time, data is archived and may be stored by a third party secure storage provider. Where personal information is stored with a third party, we have arrangements in place requiring those third parties to comply with privacy laws. We take reasonable steps to protect the privacy and security of that information, but we are not liable for any unauthorized access, disclosure or use.

Ksubaka will not knowingly collect personal data from children and will not use or disclose personal data about a child as pursuant to local law and regulations. The definition of “child” or “children” should take into account applicable laws as well as national and regional cultural customs.

Ksubaka websites contain links to other websites. Ksubaka is not responsible for the privacy practices or the content of other websites.
Disclosures of personal information to overseas recipients
We may have your personal information stored, accessed and processed overseas by our affiliated companies or service providers who are located in the US, Asia or Europe or sometimes in other countries. We take such steps as are necessary in the circumstances to ensure that any overseas entity complies with applicable privacy laws, including through our contractual arrangements, or by ensuring that the overseas entity is also bound to comply with privacy and data protection laws or schemes similar to those in our country.
